1. Introduction

These Terms & Conditions ("Terms") govern your use of the Atomicule mobile application (available on iOS and Android) and the atomicule.com website (collectively, the "Service"), operated by Atomicule ("we", "our", or "us").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 16 years old to use Atomicule. By using the Service, you confirm that you meet this requirement. If you are under 18, you confirm that you have your parent or guardian's consent.

You must provide accurate information when creating your account and keep it up to date. You are responsible for all activity that occurs under your account.

3. Accounts

You can create an account using an email address and password, or via Apple Sign-In or Google Sign-In. You are responsible for keeping your login credentials secure and must notify us immediately at support@atomicule.com if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe to be fraudulent or abusive.

4. Free Trial

New subscribers receive a 7-day free trial with full access to all features. After logging in, you will be presented with a subscription paywall where you can select a plan and begin your free trial through Apple App Store or Google Play Store.

The trial period begins when you initiate a subscription through your app store. No charges are made during the trial period. At the end of the trial, your subscription becomes active and billing begins automatically unless you cancel at least 24 hours before the trial expires.

Trial eligibility is subject to Apple App Store and Google Play Store policies. Each Apple ID or Google account is entitled to one free trial per subscription product and cannot be reset.

5. Subscriptions & Payments

5.1 Plans

Using Atomicule requires a paid subscription, which includes a free trial for new subscribers. We currently offer two plans:

Monthly
Annual

Prices may vary by region and are displayed in local currency at checkout. All prices are inclusive of applicable taxes where required by law.

5.2 Billing & Renewal

Subscriptions are billed through the Apple App Store or Google Play Store and renew automatically at the end of each billing period unless cancelled at least 24 hours before the renewal date. Subscription management (cancel, change plan, restore) is handled by your app store account settings.

5.3 Refunds

All purchases are made through Apple App Store or Google Play Store. Refund requests are subject to each platform's refund policy. We do not process refunds directly. To request a refund, use Apple's or Google's standard refund processes.

5.4 Lapsed Subscriptions

If your subscription lapses, your data — including all blocks, flows, and session history — is retained. You can resume full access by re-subscribing at any time.

6. Acceptable Use

You agree to use Atomicule only for its intended purpose — building and running personal time-block routines. You must not:

Use the Service for any unlawful purpose
Attempt to gain unauthorised access to our systems or other users' data
Reverse-engineer, decompile, or disassemble the app
Use automated tools to scrape, crawl, or interact with the Service
Interfere with the integrity or performance of the Service
Misrepresent your identity or impersonate others

Violation of these rules may result in immediate account suspension or termination without refund.

7. Your Content

All content you create within Atomicule — including block names, notes, flow names, and session records — belongs to you. By storing it on our service, you grant us a limited, non-exclusive licence to process and store it solely for the purpose of providing the Service to you.

We do not claim ownership of your content and will not share or use it for any purpose other than operating the Service.

8. Intellectual Property

The Atomicule app, website, logo, design, and all associated software are the exclusive property of Atomicule and are protected by copyright and other intellectual property laws.

Nothing in these Terms grants you a right to use the Atomicule name, logo, or branding without our prior written consent.

9. Availability & Changes

We aim to keep Atomicule available at all times but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue any part of the Service at any time. Where feasible, we will provide reasonable notice of significant changes.

We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date and notify you via the app or email. Continued use of the Service after changes are published constitutes acceptance of the updated Terms.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Atomicule does not warrant that the Service will be error-free, secure, or that any defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Atomicule shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, loss of profits, or interruption of business.

Our total liability to you for any claim arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Account Deletion

You may delete your account at any time from Settings → Delete Account within the app. Upon deletion, your account is immediately deactivated and all personal data is permanently purged within 30 days, in accordance with our Privacy Policy .

Deleting your account does not automatically cancel an active App Store or Play Store subscription. You must cancel your subscription separately through your app store account to avoid further charges.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of the Netherlands.

If you are a consumer based in the European Union, you may also benefit from any mandatory consumer protection laws in your country of residence.
